"Site" or "Platform" refers to the digital platform operated under the domain name www.eloboost.gg and all associated subdomains, owned by Digital Gaming Services LLC, a limited liability company organized under the laws of the State of Wyoming, USA, with EIN 32-0853214 and registered office at 30 N Gould St Ste N, Sheridan, WY 82801. Eloboost.gg operates as an online marketplace that connects independent service providers (Boosters/Sellers) with Buyers for the purpose of facilitating gaming-related service transactions.

Marketplace: Refers to the digital intermediary platform operated by Eloboost.gg where Buyers and independent service providers transact. The Marketplace provides the technological infrastructure, payment processing, and dispute resolution mechanisms to facilitate these transactions.

User / Member / Customer / Buyer: Any natural or legal person who registers on the Platform, purchases services, or uses the Platform in any manner.

Booster: An independent contractor (natural or legal person) who offers gaming-related services through the Eloboost.gg Platform. Boosters operate independently and are not employees, agents, or representatives of Eloboost.gg. They are solely responsible for the execution and quality of the services they provide.

Seller: An independent user who offers products owned by or under the control of themselves to other users through the Eloboost.gg Platform. Sellers operate as independent contractors and are solely responsible for their listings and transactions.

Product: Refers to goods and/or services.

Boost: Refers to the process of advancing game accounts in terms of level, league, rank, or similar progression metrics.

Service: All digital services and virtual products offered through Eloboost.gg. This includes but is not limited to: intermediary services, boosting services, game coaching services, game accounts, e-pins, and game codes.

Eloboost.gg acts as a neutral marketplace facilitator that provides the technological infrastructure for Buyers and independent service providers (Boosters/Sellers) to connect and transact. Eloboost.gg does not provide gaming services, boosting, coaching, or any other services listed on the Platform directly.

Eloboost.gg facilitates transactions between independent providers and Buyers by providing payment processing (escrow), dispute resolution, communication tools, and quality assurance infrastructure.

Eloboost.gg is not a party to the transactions between Buyers and Boosters/Sellers. The contractual relationship for service delivery exists solely between the Buyer and the independent service provider. Eloboost.gg's role is limited to providing the marketplace platform and related support services.

While Eloboost.gg implements quality assurance measures such as provider vetting, rating systems, and monitoring tools, it does not guarantee the outcome or quality of any individual service provided by independent contractors on the Platform.

The User acknowledges that all information and data provided during registration and while using the services are accurate, complete, and up to date. The User shall bear all legal liability arising from any false statements.

The User is solely responsible for maintaining the confidentiality of their account username and password. All transactions carried out through the account shall be deemed to have been performed by the User.

The User agrees to use the Platform in compliance with all applicable laws and regulations. The User shall be liable for any activities that violate applicable laws.

The Platform may not be used for spam, bots, viruses, malware, automation, activities that disrupt system operations, or activities that infringe upon the rights of third parties.

The User is solely responsible for all comments, opinions, and content shared on the Platform. Eloboost.gg cannot be held liable for such content.

The User agrees not to attempt unauthorized access to software, data, or accounts belonging to other users or third parties.

The User is responsible for ensuring the security of their own device and system when accessing the Platform. Eloboost.gg shall not be liable for any damage that may occur to the User's hardware or software.

In the event that the User obtains unfair gains through technical or software errors on the Platform, the User is obligated to immediately notify Eloboost.gg.

Eloboost.gg reserves the right to restrict, suspend, or terminate the membership of any User who violates this Agreement.

In the event of a breach of this Agreement, other accounts associated with the violating User may also be closed if deemed necessary, and any resulting damages may be offset from the User's balance.

In cases of security concerns, suspected fraud, or regulatory requirements, User balances may be temporarily frozen. If a refund is deemed appropriate following the review, it will be processed through the original payment method.

The User may not market, redirect, or commercially exploit the services offered on Eloboost.gg through external channels.

Eloboost.gg has no official affiliation with any game developers or publishers.

The User acknowledges that boosting, coaching, and similar services requested through the Platform may violate the terms of service (ToS/EULA) of the relevant game publisher. The Platform makes no warranty regarding compliance with any game publisher's terms of service. The User is solely responsible for any bans, restrictions, rank resets, or account closures that may result from using these services. The Platform reserves the right to suspend any service category upon request from a game publisher; in such cases, ongoing orders will be refunded from escrow, and no refunds will be issued for completed orders.

Service completion times are estimates and no guaranteed delivery timeframe is provided.

The Booster may use in-game resources for the proper execution of the service. The User accepts this condition.

In duo boost services, if the process is adversely affected by the User's intentional or unintentional actions, the order type may be changed and no refund shall be issued.

In coaching services, no guarantee is made regarding match wins, league promotions, or level gains.

For orders where the service has not yet commenced, cancellation or refund may be requested within 24 hours after order confirmation.

For in-progress orders, a partial refund may be issued based on the completion percentage of the service. The refund amount shall be calculated by deducting the value of the completed portion from the total order amount.

For digital services that have already been completed, refunds are generally not available, in accordance with applicable consumer protection regulations regarding digital content.

Approved refunds shall be processed within 3-14 business days, depending on the payment method used. Refunds will be issued through the original payment method unless otherwise agreed.

In the event of an unjustified chargeback, Eloboost.gg reserves the right to recover all resulting damages from the User.

Personal data belonging to Users is processed in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) where applicable. The User acknowledges that they may receive informational and promotional electronic communications in accordance with applicable legislation. Game account credentials (username, password) shared for boosting services are treated as personal data and stored in encrypted form. These credentials are used solely for the purpose of fulfilling the relevant order and are permanently deleted from Platform systems within 72 hours after order completion or cancellation. The User is responsible for changing their account password after the boosting service is completed. The Booster undertakes not to save, screenshot, or share account credentials with any third party.

System logs, transaction records, and computer records belonging to Eloboost.gg shall be considered conclusive and binding evidence for marketplace transactions.

Step 1: The disputing party must submit their dispute through the Platform's support system, providing all relevant details and evidence related to the transaction.

Step 2: Eloboost.gg shall review the evidence submitted by both parties within 7 business days of receiving the dispute. Both the Buyer and the Booster/Seller will be given the opportunity to present their case.

Step 3: Based on transaction logs, messages, system records, and submitted evidence, Eloboost.gg shall issue a binding decision regarding the dispute. This decision is final for marketplace transactions processed through the Platform.

Step 4: If the dispute remains unresolved or either party disagrees with the Platform's decision, the parties may pursue legal action. Any legal disputes arising from this Agreement shall be submitted to the competent courts and enforcement offices in Istanbul, Republic of Turkey.

Eloboost.gg shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the Platform or services obtained through the Platform.

The total liability of Eloboost.gg in any claim arising from a transaction shall be limited to the transaction amount in dispute. Under no circumstances shall Eloboost.gg's aggregate liability exceed the amount paid by the User for the specific transaction giving rise to the claim.

Eloboost.gg shall not be liable for any actions taken by game developers or publishers, including but not limited to account bans, suspensions, restrictions, or any other penalties imposed on User accounts.

As services listed on the Platform are provided by independent contractors (Boosters/Sellers), Eloboost.gg shall not be held liable for the quality, timeliness, or outcome of services delivered by these independent providers.

Internet outages, technical failures, infrastructure issues, natural disasters, cyberattacks, and other circumstances beyond the reasonable control of the parties shall be considered force majeure events. Neither party shall be held liable for delays or failures caused by such events.
