Site / Platform: The digital platform operated under the domain name eloboost.gg.

Eloboost.gg: The marketplace operator that acts as a neutral intermediary, providing digital infrastructure for transactions between Buyers and independent service providers (Boosters/Sellers), and manages payments through its Secure Transaction System (escrow).

Marketplace: The online platform operated by Eloboost.gg where Buyers and independent Sellers/Boosters connect to transact digital gaming services and products. Eloboost.gg is not a party to these transactions but facilitates them.

Buyer: A natural person who purchases game accounts, digital products, or boosting services through the Site.

Seller: A natural person who sells game accounts, in-game items, or digital products through the Site.

Booster: An independent service provider who performs in-game progression, level advancement, league/rank promotion, and similar digital services on behalf of the Buyer through the Site; not an employee of Eloboost.gg.

Product: Game accounts, in-game items, and digital assets offered for sale by the Seller through the Site.

Service: Digital gaming services performed by the Booster on the Buyer's account.

Eloboost.gg operates exclusively as a marketplace intermediary, facilitating connections between Buyers and independent Sellers/Boosters. Eloboost.gg does not itself provide, own, or control any of the Products or Services listed on the Platform.

All transactions conducted through the Platform are between the Buyer and the independent Seller or Booster. Eloboost.gg is not a party to these transactions and does not assume any obligations of the Seller or Booster.

The Platform provides the following facilitation services: an escrow payment system (Secure Transaction System), dispute mediation, quality monitoring, and communication tools between parties.

Eloboost.gg is not responsible for the actions, omissions, or quality of services or products provided by Boosters or Sellers. Users engage with Boosters and Sellers at their own discretion.

Eloboost.gg reserves the right to remove listings, suspend or terminate user accounts, and mediate disputes at its sole discretion in order to maintain the integrity and safety of the Marketplace.

The Buyer may cancel or withdraw from a Product and/or Service purchased through the Site only in accordance with the cancellation and withdrawal conditions specified on the Site.

The Buyer is obligated to pay the Product and/or Service price through the Secure Transaction System managed by Eloboost.gg. The payment shall be held in escrow until the Product is delivered by the Seller and confirmed by the Buyer, or the Service is fully completed by the Booster.

The Buyer acknowledges that Booster assignment for Service purchases will be made within 36 hours following order confirmation, and agrees to wait during this period.

The Buyer acknowledges that in the event the Seller refuses to deliver the Product or the Booster refuses to perform the Service, Eloboost.gg shall not be held liable for such refusal; however, the Buyer's payment held in escrow will be refunded.

The Buyer acknowledges that Eloboost.gg shall not be held liable for any temporary or permanent bans, restrictions, penalties, or similar sanctions that may be imposed by game companies following the receipt of a Product or Service.

The Buyer acknowledges that upon confirming the completion of the Service through the Site, the Service fee, after deduction of the Eloboost.gg commission, shall be transferred to the Booster or Seller.

The Seller represents and warrants that they own or are authorized to transfer the Product offered for sale, and that there are no legal impediments to the sale of the Product.

The Seller acknowledges that all legal liability arising from Products offered for sale rests solely with them, and that Eloboost.gg is not a party to the sale transaction.

The Seller warrants that the listing information for the Product is accurate, complete, and up to date, and that they possess all necessary access credentials for the transfer of the Product to the Buyer.

The Seller represents that the Product does not have any hidden defects, bans, restrictions, or value-diminishing characteristics.

The Seller acknowledges that they shall bear all responsibility in cases of Product recovery, locking, banning, or access loss after the sale.

The Seller agrees not to contact game companies for the purpose of recovering the Product after the sale; otherwise, the Seller shall compensate all damages incurred by the Buyer and Eloboost.gg.

The Seller acknowledges that upon completion of the sale, all rights to the Product have been transferred to the Buyer, and the Seller no longer has any connection to the Product.

In the event of a breach of this Agreement by the Seller, Eloboost.gg reserves the right to suspend or close the Seller's membership and cancel the relevant order.

The User acknowledges that "account sale" transactions refer to the de facto transfer of a license right granted by the relevant game publisher to the end user, and that such transfer may not be recognized or may be revoked by the game publisher. The Platform provides no guarantee regarding the validity or continuity of the transferred license. The Buyer may not claim compensation from the Platform if the purchased account is reclaimed by the game publisher. The Seller acknowledges that any attempt to regain access to the account after the transfer will result in escrow funds being refunded to the Buyer and the Seller's account being permanently closed.

The sale of stolen accounts, accounts obtained through unauthorized access, or accounts belonging to third parties is strictly prohibited. The Seller declares that the account offered for sale belongs to them or that they have the authority to transfer it. The Platform may request additional information and documentation to verify account ownership prior to sale. If an account is determined to be stolen, the transaction is immediately cancelled, escrow funds are frozen, the Seller's account is permanently closed, and a report may be filed with the relevant authorities.

The Booster is obligated to perform the Service undertaken through the Eloboost.gg Platform within the scope and timeframe specified in the listing, with due diligence and loyalty.

The Booster agrees to use the Buyer's account information only to the extent necessary for the performance of the Service and shall not share it with third parties.

The Booster acknowledges sole responsibility for any sanctions arising from the use of cheats, bots, prohibited software, or violations of game rules during the Service.

The Booster acknowledges that the fee shall be transferred after the completion of the Service, following the warranty period and after deduction of the Eloboost.gg commission.

The Booster acknowledges that they are not an employee of Eloboost.gg, that they provide the Service independently, and that no employer-employee relationship exists between the parties.

The Booster undertakes to perform only the actions specified in the order scope on the account to which access is granted, not to interfere with items, balance, or other digital assets on the account, and not to share account credentials with any third party. In case of violation: (a) the booster's earnings for the relevant order are cancelled, (b) compensation is paid to the affected user, (c) the booster's account is permanently closed, and (d) the Platform reserves the right to pursue legal action.

The Buyer, Seller, and Booster acknowledge that all Product and Service transaction payments made through the Site shall be processed through the Secure Account managed by Eloboost.gg.

The Secure Transaction System protects the Buyer against the risk of not receiving the Product or Service despite making payment, and protects the Seller and Booster against the risk of not receiving their fee.

Funds held in the Secure Account are not owned by Eloboost.gg and are held in escrow solely for transaction security purposes.

Eloboost.gg operates as a commission-based marketplace intermediary. A service commission is deducted from each completed transaction before the remaining amount is transferred to the Seller or Booster. The applicable commission rate is disclosed at the time of listing or order acceptance. Eloboost.gg is not a payment service provider or financial institution; it solely facilitates the transfer of funds between parties as part of its marketplace intermediary role.

Eloboost.gg fulfills its tax obligations solely on the commission income it earns as a marketplace intermediary, in accordance with the applicable legislation of its jurisdiction.

Sellers and Boosters operate as independent contractors and are solely responsible for all financial obligations arising from their earnings through the Platform, including but not limited to income tax, value-added tax, and any other fiscal duties required by the laws of their respective jurisdictions. Eloboost.gg does not act as a tax agent, does not withhold or remit taxes on behalf of any user, and shall not be held liable for any user's failure to comply with their local tax obligations. No employment, partnership, or agency relationship exists between Eloboost.gg and any Seller or Booster.

Orders that have not yet been started may be eligible for a full refund if the cancellation request is submitted within 24 hours of order confirmation.

For orders that are in progress, a partial refund may be issued calculated based on verified completion percentage, at the sole discretion of Eloboost.gg.

Completed orders are generally not eligible for refunds, as digital services are considered fully delivered.

Refund requests must be submitted through the Site's support system. All refunds will be processed through the original payment method within 3-14 business days.

Disputes regarding refund eligibility will be resolved through the Platform's Dispute Resolution procedure as outlined in Section 11 of this Agreement.

The User agrees to use the Platform's internal dispute resolution procedure before initiating a chargeback with their payment provider for any completed transaction. A chargeback initiated without exhausting the internal procedure shall be considered a breach of this Agreement. Financial losses incurred by the Platform as a result of a chargeback (transaction amount + payment provider penalty fees) may be offset from the User's Platform balance or future receivables. The Platform reserves the right to suspend the accounts of Users with a history of repeated chargebacks.

Eloboost.gg shall not be held liable for any indirect, incidental, consequential, or punitive damages arising from the use of the Platform, including but not limited to loss of profits, data, or goodwill.

The total aggregate liability of Eloboost.gg in connection with any claim arising from or related to the Platform shall be limited to the specific transaction amount in dispute.

Eloboost.gg shall not be held liable for any actions taken by game companies, including but not limited to account bans, suspensions, restrictions, or any other penalties imposed on users as a result of Products purchased or Services received through the Platform.

As all Products and Services are provided by independent Sellers and Boosters, Eloboost.gg shall not be held liable for the quality, timeliness, accuracy, or completeness of such Products or Services. Eloboost.gg's role is limited to facilitating transactions and mediating disputes.

Eloboost.gg shall not be held liable for any losses arising from unauthorized access to a user's account where the user has failed to maintain the security of their login credentials, passwords, or other access information.

Eloboost.gg shall not be held liable for any failure or delay in performing its obligations under this Agreement where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, cyberattacks, pandemics, or other force majeure events.

Step 1: The disputing party must submit a formal dispute through the Platform's support system within 48 hours of the issue arising. The dispute submission must include a clear description of the issue and any relevant supporting evidence.

Step 2: Upon receipt of the dispute, the Platform will notify all involved parties and collect evidence, statements, and documentation from each party within 3 business days.

Step 3: The Platform will review all collected evidence, including system logs, chat records, transaction data, and submitted documentation, and issue a decision within 7 business days of the evidence collection deadline.

Step 4: The Platform's decision is binding for all marketplace transactions conducted through the Secure Transaction System. Escrow funds will be released, refunded, or redistributed in accordance with the decision.

Step 5: If either party disagrees with the Platform's decision, they retain the right to pursue legal action before the competent courts in Istanbul, Republic of Turkey, within 30 days of the decision being communicated.
